As they attacked towards the Evergreen Cemetery Gatehouse atop Cemetery Hill, Col. Isaac Avery's North Carolinians dislodged two New York regiments, the 54th and 68th who had been badly mauled and routed the previous day at Blocher's Knoll. Forced to break in the face of the aggressive Confederate attack, the 54th New York's young colour bearer was struck by a confederate bullet, mortally wounded he was carried to the rear with the fallen banner.
Here, the 21st North Carolina follow the retreating regiments up the hill while beyond them the 57th North Carolina attempt to widen the breech in the Union line.
The Confederate success was short lived, The regiments supporting the retreating New York regiments held firm. Also, the mounted Col. Avery was struck in the neck by a rifle ball and fell, mortally wounded as desperate hand-to-hand fighting raged in the failing light.
As some of the the North Carolinians surged up the hill, they found the men from Consolidated Battery F and G, 1st Pennsylvania Light Artillery who refused to abandon their guns. Just as things looked desperate for the artillerymen they were reinforced by Col. Carrol's Brigade which cut short the North Carolinians' success. Avery's brigade retreated, having lost a third of it's men.
